An ordinance authorizing owners of golf carts to operate the golf cart upon the city streets of the City of Wynne, Arkansas, and regulating the same:
Be it ordained by the City Council of the City of Wynne, Arkansas:
Whereas, pursuant to AC.A. 14-54-1410, It is within the municipal affairs and authority of any municipality in the State of Arkansas to authorize by municipal ordinance any owner of a golf cart to operate the golf cart upon the city streets of the municipality; provided, however, operation shall not be authorized on city streets which are also designated as federal or state highways or as a county road;
Whereas, the City Council has determined that it does wish to authorize owners of golf carts to operate the golf cart upon the city streets of the City of Wynne, and regulate the same.
Now therefore, be it ordained by the City Council of the City of Wynne, Arkansas:
Section 1: Definitions
For the purpose of this ordinance, the following terms shall have the meanings respectively ascribed to them:
1.1 - "Golf Cart" means a motor vehicle that is designed and manufactured for operation on a golf course for sporting or recreational purposes and that is not capable of exceeding speeds of 20 miles per hour,
1.2 - "City Streets" means any public roadway maintained by the City of Wynne, excluding County, State, and Federal Highways.
Section 2: Permitted Use
2.1 - Pursuant to A.C.A. 14-54-1410, golf carts are permitted to operate on City Streets within the city limits of Wynne, Arkansas as set forth in this section .
2.2 - Pursuant to A.C.A. 14-54-1410, golf carts are prohibited from operating on or crossing any County Road, State Highway, or Federal Highway, specifically including Falls Blvd, Martin Luther King, US Highway 64 and 648, and Hamilton Avenue, unless expressly permitted for special occasions approved by the Wynne City Council.
2.3 - Golf carts may only be operated on city streets during daylight hours, which is defined for purposes of this ordinance as thirty minutes before sunrise until 30 minutes after sunset, as declared by the National Weather Service. Golf carts may be operated on city streets outside of daylight hours only if equipped with proper and fully functioning equipment to run at night, which shall include, at a minimum, headlights, taillights, and brake lights.
2.4 - No golf carts may be operated on the city streets of Lemons, Eldridge, Bridges, and Jackson from 7am to 9am and 2pm to 4pm during the school year while school is in session.
Section 3: Registration
3.1 - All golf carts operated on City Streets must be registered by the owner with the City of Wynne, Arkansas at City Hall prior to operating the golf cart on the city streets. All owners shall be charged a fee of $25.00 per year to register the golf cart with the city, and $5.00 to replace a lost or damaged registration sticker.
3.2 - Upon registration the owner will receive an official registration sticker from the City of Wynne that must be visibly affixed at all times to the golf cart, clearly displayed on the driver's side front fender/ corner of the golf cart. This registration sticker will only be valid for the calendar year that it was issued.
Section 4: Operating Requirements
4.1 - All golf cart operators must be 14 years of age or older and possess a valid driver's license or a valid intermediate permit, Operators over the age of 18 do not require a license or intermediate permit.
4.2 - Golf carts must obey all traffic laws applicable to motor vehicles. Violators of any part of this ordinance may be cited in accordance with current municipal, state, and federal laws.
4.3 - Golf cart operators may not have more passengers on the golf cart than there are seats for said passengers. All passengers shall be seated in a seat while the golf cart is in motion.
Section 5: Liability Insurance
5.1 - A golf cart operating upon the city streets of Wynne, Arkansas shall be covered by a policy of liability insurance with a required standard minimum policy limits as set by the State of Arkansas for motor vehicles traveling upon roadways within the State of Arkansas. Satisfactory proof of valid liability insurance as required herein shall be provided by the owner to the City of Wynne upon registration of the golf cart and shall be kept in said golf cart while in operation upon the city streets and shall be presented to any law enforcement officers upon reasonable and lawful request.
Section 6: Enforcement and Penalties
6.1 - Violation of any provision of this ordinance shall be considered a violation of city ordinance.
6.2 - Any person found operating a golf cart in violation of any provision of this ordinance shall, upon conviction, be fined not less than $100.00 nor more than $250.00 for each offense. Any violation of this ordinance may result in the revocation of the permit for the current year of operating said golf cart upon the city streets and shall result in the imposition of the fines as set forth herein along with court costs.
