An Ordinance designating certain public streets or highways as being open to the operation of a utility task vehicle.
Be it ordained by the City Council of the City of Wynne, Arkansas:
Whereas, pursuant to A.C.A. 27-21-111, the governing body of the city in which a public street or highway is located may adopt an ordinance designating the public street or highway within the jurisdiction of the city as being open to the operation of a utility task vehicle;
Whereas, the City Council has determined that it does wish to designate certain public streets or highways as being open to the operation of a utility task vehicle.
Now, Therefore, be it ordained by the City Council of the City of Wynne, Arkansas:
Section 1: The City of Wynne, Arkansas hereby designates all public streets and/or highways, or parts thereof, except for those designated on the attached map and list, public streets or highways that have a posted speed limit that exceeds fifty-five miles per hour, and divided four-lane highways, as being open to the operation of a utility task vehicle.
Section 2: That the driver of any utility task vehicle on any public street and/or highway in the City of Wynne, Arkansas, shall comply with all requirements set forth in A.C.A. 27-21-101 et seq, all other city ordinances, and all other state laws.
Section 3: In addition to the requirements set forth in A.C.A 27-21-101 et seq, the driver of any utility task vehicle on any public street and/or highway in the City of Wynne, Arkansas shall comply with the following regulations:
- 3.1 - Utility task vehicles may only be operated on city streets during daylight hours, which is defined for purposes of this ordinance as thirty minutes before sunrise until 30 minutes after sunset, as declared by the National Weather Service. Utility task vehicles may be operated on city streets outside of daylight hours only if equipped with proper and fully functioning equipment to run at night, which shall include, at a minimum, headlights, taillights, and brake lights.
- 3.2 - No utility task vehicles may be operated on the city streets of Lemons, Eldridge, Bridges, and Jackson from 7am to 9am and 2pm to 4pm during the school year while school is in session.
- 3.3 - Utility task vehicles must obey all traffic laws applicable to motor vehicles. Violators of any part of this ordinance may be cited in accordance with current municipal, state, and federal laws.
- 3.4 - Utility task vehicle operators may not have more passengers on the utility task vehicle than there are seats for said passengers. All passengers shall be seated in a seat while the utility task vehicle is in motion.
Section 4: Registration
- 4.1 - All utility task vehicles operated on City Streets must be registered by the owner with the City of Wynne, Arkansas at City Hall prior to operating the utility task vehicle on the city streets. All owners shall be charged a fee of $25.00 per year to register the utility task vehicle with the city, and $5.00 to replace a lost or damaged registration sticker.
- 4.2 - Upon registration the owner will receive an official registration sticker from the City of Wynne that must be visibly affixed at all times to the utility task vehicle, clearly displayed on the driver's side front fender/ corner of the utility task vehicle. This registration sticker will only be valid for the calendar year that it was issued.
Section 5: Enforcement and Penalties
- 5.1 - Violation of any provision of this ordinance shall be considered a violation of city ordinance in addition to a violation of state law.
- 5.2 - Any person found operating a utility task vehicle in violation of any provision of this ordinance shall, upon conviction, be fined not less than $100.00 nor more than $250.00 for each offense, in additional to any penalties under state law.
